Customer leaves the store. Unidentified man approaches the customer. Unidentified man asks customer where she put the unpaid for panties which the man had seen in her cart while in the store. Customer assumed that the unidentified man was an employee of the store. Unidentified man repeatedly asked customer to return to the store. Customer was feeling ill. Customer wanted to leave. Customer said her children would be coming home for lunch. Customer voluntarily opened her purse and her clothing to prove that she did not take the panties. Customer estimates that she had been questioned for approximately five minutes. Customer voluntarily follows the man back inside the store. Customer quickly finds the panties lying on the counter adjacent to the lingerie display. Customer leaves store without further ado. The court held that no arrest was made and false imprisonment cannot have occurred without an arrest. The court reasoned that nothing was being done to indicate that she was being taken into custody, or that she was being held for delivery to a peace officer to answer a criminal charge. Given what the unidentified man observed (customer placing the panties in her cart), entitled the unidentified man; acting as an agent of the owner, the right to question the customer. The customers’ voluntariness in following the man back into the store illustrates that her actions were carried out willingly amp; knowingly and shows no signs of manual seizure or coercion. Therefore the customer was not arrested. Like the customer in Bruce, Jane voluntarily followed the store clerk back into the store. However in our case, Jane had been purposely and knowingly coerced into her decision whereas the actions by the customer in Bruce were done willingly. For an arrest, there must be a manual seizure or its equivalent in some sort of personal coercion. Coercion means acting against the will of the customer. If there is no coercion, there is no arrest. The store clerk seized Jane’s dog (something of value), leaving Jane no choice but to follow. Unlike the case in Bruce, Jane’s actions were against her will and were therefore coerced. When a store employee detains something of value to a patron and the item detained is something a reasonable person would not leave without, the patron has been detained. In Clarke v. K Mart Corporation, 197 Mich. App. 541, 495 N. W. d 820 (1992), a customer and her two small children were shopping at K Mart in Grand Rapids, Michigan. Customer purchased a set of bed sheets among other things. The cashier accidentally rang up the sheets twice. Cashier set sheets aside and voided the second transaction. Cashier placed sheets into customers’ bag. The cashier supervisor observed only the sheets being placed in the customers’ bag. Cashier supervisor did not notice the sheets being rung up. Cashier supervisor along with another co-supervisor approached customer. Customer claims the co-supervisor snatched the bag out of her hand. Co-supervisor alleges he took the bag out of the customers shopping cart. The supervisors confiscate $250 worth of purchased goods and notify the customer that they will be performing a routine package check. Customer was detained for ten or fifteen minutes. Supervisors gave $10 to customer for her inconvenience. The court held that by confiscating the $250 worth of purchased goods; the customer had been coerced into staying inside the store for 10 or 15 minutes and was therefore detained. The court reasoned that if a store owner, without any privilege, purposely prevents a customer from leaving by means of taking something of value from the customer and that customer reasonably remains in the store solely for the valuables, than that customer has been confined and therefore detained. Similar to our case at hand, both Jane as well as the customer in Clarke had been confined through the detainment of personal valuables. In Clarke, the detainment of expensive bed sheets ($250) proved to be enough coercion to satisfy a confinement. In our case however, it was Jane’s dog that had been detained. Now, although it may be impossible to value the dog at any specific dollar amount, any patron willing to purchase a dog will most likely view the purchase as an investment rather than a burden. On the other hand, the defense will argue that owning a dog may be more of a liability than asset because maintaining a dog is expensive and by detaining the dog, Jane would be better off financially. The defense may have a valid argument, yet a dog is not an inanimate object; it is a pet. Accordingly, if a customer won’t leave without their bed sheets as in Clarke, than certainly a customer will not leave without there pet. Any reasonable patron understands that a dog is a living creature and has feelings just as humans do. Any reasonable dog owner can understand the impact a pet can have on a person’s life and thus love their pet as if it were their own child. Obviously, it would be unconscionable to think that a reasonable person would leave their dog behind; they would act as Jane did. Jane’s decision to go back into the store was clearly against her will and was therefore coerced. An arrest can be affected either through physical constraint or personal coercion that is the equivalent of physical constraint. In Tumbarella v. Kroger Co. , 85 Mich. App. 482, 271 N. W. 2d 284 (1978), two police officers approached a customer who was also an employee for the store. The security officers asked customer where the money was. Customer indicated that she did not know what they were talking about. Officers then made menacing gestures toward the customer. Customer felt as if she was taken in custody. The officers’ threatened the customer with prosecution and jail. Customer felt restricted in her freedom both expressly and impliedly. The court held that the customer may seek nominal damages even if the officers had probable cause to believe the customer stole money from the store. In November 1992, President - elect Clinton told Americans that he planned to lift the military's long - standing ban on gays and lesbians. Homosexual men and women, he said, should not be prevented from serving their country based on their sexual orientation. Soon after taking office in 1993, Clinton faced powerful military and congressional opposition to lifting the ban. General Colin Powell, then - chairman of the Joint Chiefs of Staff, and Senator Sam Nunn, who was chairman of the Senate Armed Forces Committee between 1987 an 1994 and left Congress in 1996, announced that they would seek to block his attempts to lift the ban. For the next six months, debate raged over what to do about the military's ban on gays and lesbians. Clinton's liberal supporters wanted him to follow through on his promise to lift the ban, urging the need to end discrimination against gays and lesbians. Whenever youve had a conversation, texted a friend, or given a business presentation, you have engaged in communication. Any time two or more people get together to exchange messages, they are engaging in this basic process. Although it seems simple, communication is actually quite complex, with a number of components. Communication Process Definition The term communication process refers to the exchange of information (a message) between two or more people. For communication to succeed, both parties must be able to exchange information and understand each other. If the flow of information is blocked for some reason or the parties cannot make themselves understood, then communication fails. The Sender The communication process begins with the sender, who is also called the communicator or source. The sender has some kind of information—a command, request, question, or idea—that he or she wants to present to others. For that message to be received, the sender must first encode the message in a form that can be understood, such as by the use of a common language or industry jargon, and then transmit it. The Receiver The person to whom a message is directed is called the receiver or the interpreter. To comprehend the information from the sender, the receiver must first be able to receive the senders information and then decode or interpret it.   The Message The message or content is the information that the sender wants to relay to the receiver. Additional subtext can be conveyed through body language and tone of voice. Put all three elements together—sender, receiver, and message—and you have the communication process at its most basic. The Medium Also called the channel, the  medium  is the means by which a message is transmitted. Text messages, for example, are transmitted through the medium of cell phones.  Ã‚   Feedback The communication process reaches its final point when the message has been successfully transmitted, received, and understood. The receiver, in turn, responds to the sender, indicating comprehension. Feedback may be direct, such as a written or verbal response, or it may take the form of an act or deed in response (indirect). Other Factors The communication process isnt always so simple or smooth, of course. These elements can affect how information is transmitted, received, and interpreted: Noise: This can be any sort of interference that affects the message being sent, received, or understood. It can be as literal as static over a phone line or radio or as esoteric as misinterpreting a local custom.Context: This is  the setting and situation in which communication takes place. Like noise, context can have an impact on the successful exchange of information. It may have a physical, social, or cultural aspect to it. But somethings amiss: Roberto bought chocolate milk, and Brenda wanted regular milk.   In this example, the sender is Brenda. The receiver is Roberto. The medium is a text message. This disease is the most common genetic disorder amongst Caucasians. Cystic fibrosis affects about one in 2,500 people, with one in twenty five being a heterozygote. With the use of antibiotics, the life span of a person afflicted with CF can be extended up to thirty years however, most die before the age of thirteen.1 Since so many people are affected by this disease, its no wonder that CF was the first human genetic disease to be cloned by geneticists. In this paper, I will be focusing on how the cystic fibrosis gene was discovered while at the same time, discussing the protein defect in the CF gene, the bio-chemical defect associated with CF, and possible treatments of the disease. Finding the Cystic Fibrosis Gene:The classical genetic approach to finding the gene that is responsible for causing a gene tic disease has been to first characterize the bio-chemical defect within the gene, then to identify the mutated protein in the gene of interest, and finally to locate the actual gene. However, this classical approach proved to be impractical when searching for the CF gene. To find the gene responsible for CF, the principle of reverse genetics was applied. Scientists accomplished this by linking the disease to a specific chromosome. After this linkage, they isolated the gene of interest on the chromosome and then tested its product.2Before the disease could be linked to a specific chromosome, a marker needed to be found that would always travel with the disease. This marker is known as a Restriction Fragment Length Polymorphism or RFLP for short. RFLPs are varying base sequences of DNA in different individuals which are known to travel with genetic disorders.3 The RFLP for cystic fibrosis was discovered through the techniques of Somatic Cell Hybridization and through Southern Blot E lectrophoresis (gel separation of DNA). By using these techniques, three RFLPs were discovered for CF; Doc RI, J3.11, and Met. Utilizing in situ hybridization, scientists discovered the CF gene to be located on the long arm of chromosome number seven. Soon after identifying these markers, another marker was discovered that segregated more frequently with CF than the other markers. This meant the new marker was closer to the CF gene. At this time, two scientists named Lap-Chu Tsui and Francis Collins were able to isolate probes from the CF interval. They were now able to utilize to powerful technique of chromosome jumping to speed up the time required to isolate the CF gene much faster than if they were to use conventional genetic techniques.3In order to determine the exact location of the CF gene, probes were taken from the nucleotide sequence obtained from chromosome jumping. To get these probes, DNA from a horse, a cow, a chicken, and a mouse were separated using Southern Blot ele ctrophoresis. Four probes were found to bind to all of the vertebrates DNA. This meant that the base pairs within the probes discovered contained important information, possibly even the gene. Two of the four probes were ruled out as possibilities because they did not contain open reading frames which are segments of DNA that produce the mRNA responsible for genes. This could be accomplished because Northern Blot electrophoresis utilizes RNA instead of DNA. The RNA of cell types affected with CF, along with the RNA of unaffected cell types were placed on a gel. Probe number two bound to the RNA of affected cell types in the pancreas, colon, and nose, but did not bind to the RNA from non-affected cell types like those of the brain and heart. Probe number one did not bind exclusively to cell types from CF affected areas like probe number two did. From this evidence, it was determined that probe number two contained the CF gene. While isolating the CF gene and screening the genetic library made from mRNA (cDNA library), it was discovered that probe number two did not hybridize. The chances for hybridization may have been decreased because of the low levels of the CF gene present within the probe. Hybridization chances could also have been decreased because the cDNA used was not made from the correct cell type affected with CF. The solution to this lack of hybridization was to produce a cDNA library made exclusively from CF affected cells. This new library was isolated from cells in sweat glands. By using this new cDNA library, probe number two was found to hybridize excessively. It was theorized that this success was due to the large amount of the CF gene present in the sweat glands, or the gene itself could have been involved in a large protein family. Nevertheless, the binding of the probe proved the CF gene was present in the specific sequence of nucleotide bases being analyzed. The isolated gene was prov en to be responsible for causing CF by comparing its base pair sequence to the base pair sequence of the same sequence in a non-affected cell. The entire CF cDNA sequence is approximately 6,000 nucleotides long. In those 6,000 n.t.s, three base pairs were found to be missing in affected cells, all three were in exon #10. This deletion results in the loss of a phenylalanine residue and it accounts for seventy percent of the CF mutations. The 1,480 amino acid protein structure of CFTR closely resembles the protein structure of the ABC-transporter super family. It is made up of similar halves, each containing a nucleotide-binding fold (NBF), or an ATP-binding complex, and a membrane spanning domain (MSD). The MSD makes up the transmembrane Cl- channels. There is also a Regulatory Domain (R-Domain) that is located mid-protein which separates both halves of the channels. The R-Domain is unique to CFTR and is not found in any other ABC-transporter. It contains multiple predicted binding sites for protein kinase A and protein Kinase C.4 Mutations in the first MDS are mainly found in exon #4 and exon #7. These types of mutations have been predicted to alter the selectivity of the chloride ion channels.4 Mutations that are in the first NBF are predominant in CFTR. As previously mentioned, 70 percent of the mutations arising in CF cases are deletions of three base pairs in exon #10. These three base pairs give rise to phenylalanine and a mutation at this site is referred to as DF508.5 Such a mutation appears not to interfere with R-Domain phosphorylation and has even been reported to transport chloride ions.6;7 There are five other frequent mutations that occur in the first NBF. The first is a deletion of an isoleucine residue, DF507. The second is a substitution of glycine or amino acid #551 by aspartic acid/F551D. The third involves stop mutations at arginine #553 and glycine #542. The fourth is substitutions of serine #549 by various other residues. The fifth is a predicted splicing mutation at the start of exon #11.7Mutations within the R-Domain are extremely rare. The only reason they do occur is because of frameshifts. Another affected, independently regulated chloride channel that has been discovered is activated by calcium-dependent protein kinases. Sodium ions have also been noted to be increasingly absorbed by apical sodium channels.8 Therefore, the lack of regulated chloride ion transport across the apical membranes and apical absorption of sodium ions, impedes the extracellular presence of water. Water will diffuse osmotically into cells and will thus cause the dehydration of the sol (5- mm fluid layer of the cell membrane) and the gel (blanket of mucus) produced by epithelial cells.9 As a result of this diffusion of water, ai rways become blocked and pancreatic proteins turn inactive. An Account of the Absorption and Secretion of Cl-, Na+, and Proteins:An inward, electrochemical Na+ gradient is generated by the Na+, K+-ATPase pump located in the basolateral membrane (the cell side facing the organ it is lining). A basolateral co-transporter then uses the Na+ gradient to transport Cl- into the cell against its own gradient. This is done in such a way that when the apical Cl- channels within the membrane spanning domain open, Cl- diffuse passively with their gradient through the cell membrane.4In pancreatic duct cells, a Na+, H+-ATPase pump is used and a bicarbonate secretion is exchanged for Cl- uptake in the apical membrane. Chloride ions then diffuse passively when the Cl- channels are opened. Such secretions also allow for the exocytosis of proteins in the pancreas which will later be taken into the small intestines for the breaking down of carbohydrates.4In addition to the pump-driven gradients and se cretions, there exists autonomic neurotransmitter secretions from epithelial cells and exocrine glands.
